These terms apply between you and Niclas Collmer (address in the imprint), the provider of Mitovo. The German version is legally binding; this English version is provided for convenience.

1. What Mitovo is

Mitovo is a training and wellness app. It creates and adapts training and nutrition plans from your Apple Health data and your own input, and explains them.

Mitovo is not a medical device and does not give medical advice. It does not diagnose, treat, cure or prevent any disease. Its plans, scores and explanations are general fitness information. If you have a health condition, take medication, are pregnant, have had surgery or are unsure whether training is safe for you, talk to a doctor before you start and follow their advice over the app’s. Stop training and get medical help if you feel chest pain, severe shortness of breath, dizziness or other warning signs.

2. Who can use it

You must be at least 16 years old. Mitovo is currently in a private beta: access is by invitation, and we may limit the number of users.

3. Your account

You sign in with a code sent to your email address or with Sign in with Apple. Keep access to your email and device safe. You are responsible for what happens in your account. You can delete your account at any time in the app.

4. Training at your own risk

You decide which sessions you do and how hard you train. Listen to your body: plans are suggestions that depend on the data you provide, and data from wearables can be inaccurate. The coach uses AI models, which can make mistakes; check suggestions that seem wrong and ask the coach or a professional if in doubt.

5. The beta

During the beta, Mitovo is free. Features may change, be removed or be unavailable at times, and data may be reset in exceptional cases, after we tell you. We will tell you in good time before any paid plan starts; you will never be charged without actively choosing a paid plan.

6. Fair use

Don’t misuse Mitovo: no attempts to access other people’s data, no attacks on the service, no automated mass requests, and no use of the coach for content unrelated to training, health and nutrition. We may suspend accounts that break these rules.

7. Content and rights

The app, its texts, designs and exercise illustrations belong to us. The data you enter remains yours; you allow us to process it to provide the service as described in the privacy policy.

8. Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health caused by us. For slight negligence we are liable only for breaches of essential obligations (obligations whose fulfilment makes the use of the service possible in the first place and on which you may rely), limited to the typical, foreseeable damage. Liability under the German Product Liability Act remains unaffected. Since Mitovo is provided free of charge during the beta, our liability is otherwise limited to intent and gross negligence (§§ 521, 599 BGB by analogy).

9. Ending use

You can stop using Mitovo and delete your account at any time. We can end the beta or the service with reasonable notice; we will give you time to request a copy of your data.

10. Changes to these terms

We may change these terms for valid reasons, such as new features or legal requirements. We will tell you in the app before changes take effect; if you don’t agree, you can delete your account.

11. Final provisions

German law applies. If you are a consumer living in another EU country, the mandatory consumer protection rules of that country remain unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
